These "Terms and Conditions" govern the use of www.debtorchecker.co.uk by members and non-members.
Members have a responsibility to keep their registration details accurate and up to date.
Members have the responsibility to keep any information they receive from DebtorChecker private to their organisation and only use this information to make informed decisions about existing and future dealings with new and existing customers. Members should only keep information retrieved from DebtorChecker for as long as necessary and dispose of this information in a secure and confidential fashion when the information is no longer needed.
Before a member adds a debtor to DebtorChecker they should ensure that they have tried all reasonable collection procedures to recover the debt. Only when the member has received no satisfactory outcome to their own debt collecting procedures should they add their debtor to the DebtorChecker list. A member should not add any disputed or challenged debts but work to resolve the dispute. If a debt becomes disputed after being added to the DebtorChecker database it must be removed from the database by the member until the dispute is resolved.
DebtorChecker encourages businesss of all sizes to be more professional in their approach to financial control. Members use a "Contract of Work" or similar document before any work is commenced or delivery of goods made.
This can be a simple document that sets out what work you agree to do and at what cost. The following statement is added to this contract:
"The member is a member of www.DebtorChecker.co.uk and in the event of non-payment reserves the right to add the customer's details and details of their debt to DebtorChecker's database. By accepting this contract you the customer are giving permission for your details and the details of the debt to be added to the DebtorChecker database in the event of non-payment."
It is a legal requirement that any debtor that is added to the DebtorChecker list has to be informed that their details are being added to the DebtorChecker list. This should be done in form of a final letter, giving the debtor a grace period in which if they pay their debt in full they can avoid being placed on the DebtorChecker list. Informing the debtor is the legal responsibility of the Member. DebtorChecker does not inform the debtor that they have been placed on the DebtorChecker list.
A copy of this final letter and a copy of the contract of works or similar document must be posted to DebtorChecker within 2 weeks of adding a debtor to DebtorChecker. If these documents are in order, DebtorChecker will make live the details of your debtor and their debt so they can be seen by other members. DebtorChecker will delete the details of their debt if copies of the final letter or contract of works or similar document is not received within 2 weeks.
Members are responsible for the accuracy and content of the information they place on the DebtorChecker list about a debtor. They need to ensure that this information is up to date and that it only pertains to the actual debt that debtor has with your company.
When contacting or corresponding with a Debtor with regard to DebtorChecker and its service, the Member will ensure that privacy and confidentiality of the debtor is respected, so as not to act in a way likely to be publicly embarrassing to the debtor. The Member will make sure that all postal correspondence is in a confidential envelope and properly addressed to the debtor concerned.
For data security, DebtorChecker will only reply to letters, emails and telephone calls that have been received from the actual person named in the membership registration.
Debtors can request a report detailing any details DebtorChecker holds about them. We will only send requested reports with a single debtor's details if requested by the actual debtor. This will only be posted to the address contained in the debtor entry in the DebtorChecker database.
DebtorChecker will sometimes provide communication between a Member and a Debtor. DebtorChecker's decision will be final and we reserve the right to delete a debtor's record from the DebtorChecker database.
DebtorChecker reserves the right to cancel a Member's membership for any reason DebtorChecker sees fit. The Member concerned will be told in writing of DebtorChecker's decision and the reasons for cancelling their membership. Any member whose membership is cancelled will also have all their debtors details deleted from the DebtorChecker's database. DebtorChecker will have no liability for any loss to the member arising out of the cancellation of their membership.
DebtorChecker will not be liable to any user of DebtorChecker whether a member or non-member for any loss (monetary or otherwise) or damage however caused. Any user of the DebtorChecker website does so at their own risk and takes full responsibility for their own use of the DebtorChecker's website.
A member has the responsibility to keep their account information including Usernames and Password used to access the DebtorChecker's site secure and confidential. The member will inform DebtorChecker immediately if a breach of their security occurs in respect of their DebtorChecker account details.
DebtorChecker and its Members will comply fully with the Consumer Credit Act 1974 and the Data Protection Act 1998. Members will indemnify DebtorChecker against any claims (monetary or otherwise) and expenses incurred by DebtorChecker arising out of any claim made by a third party in connection with the infringement of either the Consumer Credit Act 1974 and the Data Protection Act 1998.
DebtorChecker has a responsibility to protect the confidentiality of any information a user (member or non-member) of the DebtorChecker website may divulge in the use of the website. DebtorChecker will store and use personal information about users (members and non-members) of the DebtorChecker website for the sole purpose of providing the services DebtorChecker offers.
DebtorChecker is a secure online web application. All passwords are encrypted and all payments taken are done so through the secure online payment website PayPal.
DebtorChecker reserves the right to alter or amend these Terms and Conditions from time to time. If you use the DebtorChecker website frequently or are a member it is recommended that you read these terms and conditions from time to time in order to keep informed of any changes.
